Seth J. MacArthur is a Partner in the firm’s New York office. Seth’s practice is focused on personal injury law litigation in the areas of construction accidents and Labor Law, premises liability, as well as serious motor vehicle liability cases. For more than nineteen years, Seth has helped the injured by representing them in litigation in both federal and state courts. Prior to joining Faruqi & Faruqi, Seth was the managing attorney at a prominent New York City personal injury law firm. He has extensive experience in all phases of the personal injury litigation process.

Representation of a 36-year-old union construction worker who was injured when a piece of plywood fell on him at a construction site. Plaintiff suffered serious bodily injury to his head, shoulder and neck creating the need for cervical discectomy surgery. The case alleged that defendants violated the Labor Law Statute sections 240 and 241(6). The case was litigated up to trial with issues presented to the Appellate Division 2nd department. Case was ultimately settled for $2,400,000 prior to jury selection.
Representation of a 52-year-old construction worker who was injured when he fell through a hole in the floor while doing demolition work at a construction site. Plaintiff suffered serious injuries to his back, neck and left knee resulting in multiple surgeries. The case alleged that defendants violated the Labor Law Statute section 240. Litigation of the case was completed and the matter was set for trial. Defendants settled the action prior to trial in the amount of $2,350,000.
Representation of a 49-year-old union carpenter who was injured when a tractor trailer backed into him while working at a construction site. Plaintiff suffered a fractured pelvis with damage to his urethra resulting in multiple surgeries. The case alleged that defendants violated sections 200 and 241 (6) of the New York State Labor Law statute. The matter was settled before trial in the amount of $2,200,000.
Representation of a 37-year-old union elevator mechanic who was seriously injured when he was caused to fall down an elevator shaft while making repairs to the elevator lead cables. Plaintiff’s injuries to his back and neck were so severe causing him to become paralyzed from his neck down. A lawsuit was filed in New York County alleging that the defendants violated sections 200, 240 and 241(6) of the New York State Labor Law statute, specifically for failure to provide the proper safety equipment. The case is pending before the Appellate Division 1st department.
Representation of a family who suffered emotional distress due to the mishandling and loss of remains of a family member by the funeral home hired to perform funeral services. The action was brought under the common law right of “sepulcher” when the decedent was unintentionally cremated, and the remains were subsequently lost. The funeral home and crematory were forced into a settlement well into six figures payable to the decedent’s family.
Represented multiple individuals who were injured in the 2013 Metro North train derailment that occurred in the Bronx in 2013. Each plaintiff suffered serious injuries ranging from fractured limbs, facial scarring, traumatic brain injury and fractures to the back and neck. Liability was established against Metro North when it was determined that the train was operating at a speed too fast for the location of the accident and that the train did not have a positive train control device that would have reduced the train’s speed. Prior to trial, significant monetary settlements were achieved at mediation for a number of the cases, each under a confidentiality agreement.
Seth is active in multiple bar associations, including the Richmond County Bar Association, the New York State Trial Lawyers Association and the New York State Bar Association.
Seth earned his J.D. from Albany Law School and his B.S. in Political Science from the New York State University at Oneonta. He is licensed to practice law in New York and is admitted to practice before the United States District Court for the Eastern District of New York.
